Terms of Service
Acceptance of Terms
By downloading, installing, or using the Develupp App ("App"), you ("User") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
These Terms apply to all users of the App, including coaches, sports scientists, academy administrators, and club staff.
Description of Service
Develupp is a professional sports performance tool designed to assist qualified coaches and sports practitioners in tracking the growth, maturity, and development of youth athletes. The App provides:
- Height and sitting height measurement via AR scanning and manual entry.
- Import of third-party ultrasound skeletal maturity data (e.g. SonicBone).
- Biologically validated maturity assessment scores (Mirwald, Moore, Fransen, SITAR methods).
- Predicted adult height estimates (Khamis-Roche and SITAR methods).
- Growth velocity and body proportion analysis.
- Injury recording and surveillance dashboards at the player, team, and organisation level, including maturation-adjusted injury analysis based on IOC 2020 Consensus Statement methodologies.
- Team and player management for sports organisations.
The App is intended as a decision-support tool for sports professionals. It is not a medical device and does not provide clinical diagnoses, medical advice, injury diagnoses, or treatment recommendations. Injury records entered in the App are user-reported observations, not clinical assessments.
With your consent, the App may use de-identified biometric data to train new predictive models that go beyond the population-specific equations currently embedded in the App. Full details, including what data is used and how to manage your preference, are in our Privacy Policy under "Machine Learning & Model Training."
Consent & Responsibility for Athlete Data
You are solely responsible for ensuring that all necessary consents are obtained before entering any athlete's personal or biometric data into the App. This includes:
- Obtaining informed consent from the parent or legal guardian of any athlete under the age of 18 before recording their data.
- Complying with all applicable data protection laws in your jurisdiction (including GDPR, UK GDPR, COPPA, or equivalent local legislation).
- Ensuring athletes and their guardians understand what data will be collected — including standing & sitting height, body weight, growth and growth velocity, and injury records — and how it will be used.
- Obtaining appropriate consent before recording injury data, which may constitute sensitive health information under certain jurisdictions (e.g. "special category data" under GDPR). You must ensure that your organisation's data protection and safeguarding policies explicitly cover the recording and storage of injury information for minors.
The App includes a built-in parental consent workflow that allows you to send a consent request directly to a guardian's email address and record their signed electronic consent. Use of this feature does not automatically satisfy your legal obligations. You remain responsible for verifying that consent is valid and compliant with the applicable laws in your jurisdiction. The consent form presented to guardians discloses the data types listed above.
Develupp is not responsible for any failure to obtain appropriate consent or for any breach of local data protection law resulting from your use of the App.
Acceptable Use
You agree to use the App only for its intended purpose and in compliance with all applicable laws. You must not:
- Enter data for athletes without appropriate authorisation and consent.
- Use the App to make clinical, medical, or diagnostic decisions.
- Use injury records or injury surveillance reports as medical records, insurance documentation, or clinical evidence. Injury data in the App is intended for internal sports performance management only.
- Share your account credentials with unauthorised individuals.
- Attempt to reverse engineer, decompile, or extract proprietary algorithms from the App.
- Scrape, export, or resell data for purposes other than your own organisation's internal use.
- Use the App in any way that could harm athletes, mislead parents or guardians, or misrepresent the nature of the App's outputs.
- Attempt to gain unauthorised access to other users' data or any part of our infrastructure.
Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at support@develupp.app if you suspect any unauthorised access to your account.
Develupp is not liable for any loss or damage arising from your failure to maintain account security.
Intellectual Property
All content, design, algorithms, and features within the App are the intellectual property of Develupp or its licensors. Nothing in these Terms grants you any right, title, or interest in the App other than the limited licence to use it for its intended purpose.
The scientific equations used in the App (Mirwald, Moore, Fransen, Khamis-Roche, SITAR) are based on peer-reviewed published research. References are available in Settings → Methodology & References.
The App supports importing data from third-party devices such as SonicBone. Develupp is not affiliated with, endorsed by, or responsible for any third-party hardware, software, or the data it produces. All third-party data, assessments, and clinical interpretations are the sole responsibility of the respective device manufacturers. Develupp aggregates such data for visualization and tracking purposes only.
Subscriptions & Payments
Access to certain features of the App requires a paid subscription ("Coach Pass" or "Academy Pass"). Subscriptions are offered on a monthly or annual basis and are managed through your Apple ID via the Apple App Store.
Auto-Renewal: Subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current billing period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period at the same price as your current subscription.
Billing: Your Apple ID will be charged at the time of purchase confirmation and at each subsequent renewal. You can view and manage your subscriptions — including turning off auto-renewal — in the App Store: go to Settings → [your Apple ID] → Subscriptions on your device.
Cancellation: Cancelling a subscription stops future renewals. Access to paid features continues until the end of the current paid period. Cancellation does not entitle you to a refund for any unused portion of the current billing period.
Refunds: All payments are processed by Apple Inc. Subscription fees are non-refundable except as required by applicable law or Apple's refund policies. To request a refund, contact Apple directly at reportaproblem.apple.com.
Price Changes: We reserve the right to change subscription prices at any time. You will be notified of any price change before it takes effect. Continued use after a price change constitutes acceptance of the new price.
Free Trials: Where a free trial is offered, unused portions of a free trial period are forfeited when you purchase a subscription. Only one free trial per product per Apple ID is permitted.
Develupp does not store, process, or have access to your payment card information. All payment data is handled exclusively by Apple Inc. and is subject to Apple's terms and conditions.
Limitation of Liability
To the maximum extent permitted by applicable law, Develupp and its officers, employees, and partners shall not be liable for:
- Any decisions made by coaches, administrators, or organisations based on App outputs, including injury surveillance reports, maturation-adjusted injury analysis, or return-to-play decisions.
- Inaccuracies in AR-based or manually entered measurements.
- Statistical variation in maturity scores or predicted adult heights.
- The accuracy, completeness, or clinical relevance of injury records entered by users or the injury surveillance metrics derived from them.
- Any training, selection, or return-to-play decisions made using injury data or injury-growth correlation reports generated by the App.
- Loss of data resulting from account deletion, network failure, or device issues.
- Any indirect, incidental, special, or consequential damages arising from your use of the App.
Our total liability for any claim arising from your use of the App shall not exceed the amount paid by you for the App in the 12 months preceding the claim.
Disclaimers
The App is provided "as is" and "as available" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the App will be error-free, uninterrupted, or free of viruses or other harmful components.
Termination
We reserve the right to suspend or terminate your access to the App at any time, with or without notice, if we believe you have violated these Terms or if your use poses a risk to other users, athletes, or the integrity of the App.
Upon termination, your right to use the App ceases immediately. You may export your data prior to account closure via Settings → Export Data to CSV.
Changes to These Terms
We may update these Terms from time to time. When we do, we will update the effective date at the top of this page. For material changes, we will notify you through the App or by email. Continued use of the App after changes are posted constitutes your acceptance of the updated Terms.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Connecticut in the United States of America, without regard to its conflict of law provisions.
Any disputes arising from these Terms or your use of the App shall be resolved in the courts of the State of Connecticut in the United States of America.
